1. Agreement
These Terms of Service govern your use of the website at kmeducation.com.au and any courses, instruments, licences or services provided by Kolesky Medical Education Pty Ltd (ABN 14 696 974 562) ("KME", "we", "us").
By using this website or purchasing any service, you agree to be bound by these Terms. If you do not agree, you must not use the website or purchase services.
2. Definitions
"Course" means any CPD educational product offered by KME, including ADHD Unmasked
"Instrument" means any clinical instrument offered by KME, including the Kolesky-ADHD-EFA®
"Licence" means a Practitioner Licence Agreement entered into between KME and a licensee
"User", "you", "your" means any person using this website or purchasing services from KME
3. Use of the website
You agree to use this website only for lawful purposes and in a manner consistent with these Terms. You must not:
Attempt to gain unauthorised access to any part of the website or related systems
Copy, reproduce or redistribute content from this website without written permission
Use the website to transmit malicious code, spam or harmful content
Misrepresent your identity or affiliation
4. Course purchase, access and refunds
Course access is granted upon receipt of full payment. Access is valid for twelve months from the date of enrolment, after which re-enrolment is available at a discounted rate.
Once you have accessed any course content, the course is non-refundable. Your statutory rights under the Australian Consumer Law are unaffected.
Course content is delivered through Thinkific. Use of Thinkific is also subject to Thinkific's own terms and privacy policy.
5. Instrument access
Patient access to KME instruments is granted upon receipt of full payment. Each purchase entitles the user to one complete assessment workflow, with the resulting summary delivered to the nominated treating practitioner.
KME instruments are structured screening tools. They do not constitute a diagnosis. Diagnosis and management remain the responsibility of the treating practitioner.
Practitioner use of any KME instrument requires a separate Practitioner Licence Agreement.
6. Intellectual property
All intellectual property in the courses, instruments, materials and content offered through this website is owned by Beacon Ventures Pty Ltd as trustee for the Kolsen Family Trust and exclusively licensed to KME.
Kolesky-ADHD-EFA® and any other named KME instruments or courses are trademarks of Beacon Ventures Pty Ltd as trustee for the Kolsen Family Trust.
Purchase of a course or instrument grants you a limited, non-transferable, non-exclusive licence to access and use the content for your own clinical or educational purposes. You may not reproduce, redistribute, share, sub-licence or commercialise any content without prior written permission.
7. Disclaimers – clinical and educational
All content provided by KME is for the clinical and educational use of registered medical and allied health practitioners. It is not, and is not intended to be, personal medical advice for any individual patient.
Course content reflects the clinical opinion of the author at the time of publication. Clinical guidelines, regulatory frameworks and prescribing requirements change over time. Practitioners are responsible for ensuring their clinical practice complies with current law, regulations, and the standards of their professional college.
Nothing in any KME course or instrument substitutes for clinical judgement. The treating practitioner remains solely responsible for diagnosis and management of any patient.
8. Limitation of liability
To the maximum extent permitted by law, KME's total liability to you for any claim arising out of or in connection with the website, a course, an instrument or any other service is limited to the amount you paid for the relevant service.
KME is not liable for any indirect, consequential, incidental or special loss or damage, including loss of revenue, loss of profit or loss of opportunity.
Nothing in these Terms excludes any rights or remedies available to you under the Australian Consumer Law that cannot lawfully be excluded.
9. Privacy
Our handling of personal information is governed by our Privacy Policy, available on this website.
10. Governing law and jurisdiction
These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.
11. Changes to these Terms
We may update these Terms from time to time. The most current version is always published on this page. Continued use of the website after a change constitutes acceptance of the updated Terms.
